Terms of Service

These Terms of Service ("Terms") govern your use of MOODZ content and services, operated by PAX ANIMI RECORDS S.R.L. ("MOODZ", "we", "us", or "our"), a Romanian limited liability company. By accessing or interacting with MOODZ content on YouTube, Instagram, TikTok, our website at moodzhq.com, or related services, you agree to these Terms.

In short: MOODZ is ambient audio and soundscapes, 100% human-made, curated by professionals. Listen freely on the platforms where we publish. Don't redistribute commercially or use our work to train AI. Be kind to others in the comments. That's it.

1. The Service

MOODZ produces and publishes ambient audio recordings, soundscapes, and accompanying visual content on YouTube, Instagram, and TikTok. All MOODZ content is produced, mixed, and curated by human professionals — no AI is used in the creation of our music, audio, video footage, thumbnails, or titles.

2. Use of MOODZ Content

2.1 Permitted Use

You are welcome to:

• Listen to and watch MOODZ content on the platforms where we publish (YouTube, Instagram, TikTok).
• Share MOODZ content via the native sharing features of those platforms (e.g., the YouTube "Share" button, IG/TT reshare).
• Embed MOODZ YouTube videos on personal blogs or non-commercial websites, in accordance with YouTube's Terms of Service.
• Reference MOODZ in editorial, journalistic, or educational contexts with appropriate attribution.

2.2 Prohibited Use

You may NOT, without our prior written permission:

• Download, copy, redistribute, or rehost MOODZ audio, video, thumbnails, or other content outside of the native streaming on YouTube, Instagram, or TikTok.
• Use MOODZ content commercially, including as background music in advertisements, videos, podcasts, livestreams, public venues, or commercial products.
• Modify, remix, extract stems from, or create derivative works based on MOODZ audio or video.
• Use MOODZ content as training data for any machine learning model, neural network, large language model, generative audio model, or AI system of any kind. This includes but is not limited to use in audio generation, music generation, voice synthesis, video generation, or image generation models. This restriction is fundamental to our brand promise of human-made audio.
• Represent or imply that MOODZ endorses, sponsors, or is affiliated with any product, service, or third party without our explicit written authorization.
• Remove, alter, or obscure any copyright notices, watermarks, or attribution from MOODZ content.

3. Intellectual Property

All MOODZ content — including but not limited to audio recordings, musical compositions, video footage, thumbnails, photographs, artwork, the MOODZ name, logo, and brand identity — is owned by PAX ANIMI RECORDS S.R.L. or licensed under exclusive agreements with the original creators. All rights reserved.

Music compositions are produced by our internal creative team (Dorian Micu, Andrei Mihai, Gabriel Stanoiu) under copyright assignment agreements (Drepturi de Autor contracts per Codul Fiscal Art. 72-75). Visual content is produced or curated by the same team or licensed from human creators with proper attribution.

4. User Conduct on MOODZ Channels

When commenting on or interacting with MOODZ content on YouTube, Instagram, or TikTok, you must comply with both these Terms and the host platform's community guidelines. Specifically:

• Do not post spam, advertising, or promotional content.
• Do not harass, threaten, or abuse other users or MOODZ team members.
• Do not post copyrighted material that you do not have the right to share.
• Do not impersonate MOODZ, our team, or other commenters.

We reserve the right to hide, delete, or report comments that violate these Terms or platform guidelines. We may also block or mute users who repeatedly violate these standards.

5. Brand Promise — Human-Made, No AI

MOODZ commits to producing all public-facing content (music, audio, visual footage, thumbnails, titles) using human professionals only — no AI generation tools are used in our creative pipeline. This commitment is fundamental to our brand identity.

Tool-assistive AI (e.g., mastering plugins with ML noise reduction, video editing software with auto-color features) may be used as tools by our human creators, but the creative work itself remains human. AI music generators (Suno, Udio, Riffusion, etc.) and AI video generators (Runway, Sora, etc.) are not used.

If we ever identify that AI-generated content has inadvertently entered our pipeline (e.g., via a stock asset that turned out to be AI-generated), we will remove and reissue the affected content.

6. Disclaimer of Warranties

MOODZ content is provided "as is" and "as available", without warranty of any kind, express or implied. We do not warrant that MOODZ content will be uninterrupted, error-free, or available at all times. Specific therapeutic, sleep, medical, or wellness outcomes are not guaranteed; MOODZ content is intended for general enjoyment and atmospheric listening.

If you have a medical condition, consult a qualified healthcare provider before relying on MOODZ content for sleep, stress relief, or therapeutic purposes.

7. Limitation of Liability

To the maximum extent permitted by applicable law, PAX ANIMI RECORDS S.R.L., its officers, members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of MOODZ content or services, including but not limited to loss of data, loss of revenue, or loss of enjoyment.

Our total cumulative liability for any claim arising under these Terms shall not exceed one hundred (100) Euros.

8. Indemnification

You agree to indemnify and hold harmless PAX ANIMI RECORDS S.R.L. from any claims, damages, or expenses arising from your violation of these Terms, your misuse of MOODZ content, or your infringement of any third party's rights.

9. Termination

We may, at our discretion, restrict your access to MOODZ content (e.g., by blocking or muting on platform channels) if you violate these Terms. You may stop using MOODZ services at any time by ceasing to access our content.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania. Any disputes arising from or relating to these Terms or the use of MOODZ content shall be resolved exclusively by the competent courts in Argeș County, Romania, subject to mandatory consumer-protection provisions of the European Union.

11. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of MOODZ content after a revision constitutes acceptance of the revised Terms. Material changes will be communicated via our YouTube community tab or other reasonable means.

12. Severability

If any provision of these Terms is found unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
